Terms and Conditions

By creating and sharing a personal donation page to benefit Hamilton Health Sciences Foundation (“HHSF”), I acknowledge and agree to abide by all applicable laws and regulations (including those established by the Canada Revenue Agency (“CRA”), the HHSF Privacy Policy, and the following terms and conditions.

I understand that I am solely responsible for the creation, management, and promotion of my personal donation page and any associated communications. I agree that all funds raised through my donation page are intended for HHSF and will be directed accordingly. I acknowledge that any expenses I incur are my sole responsibility, and HHSF is not liable for any costs or losses I may incur.

I agree to conduct my donation efforts in a truthful, respectful, and lawful manner. I will not make any false, misleading, or unauthorized statements about HHSF, its programs, or how donated funds will be used. I will clearly communicate to donors that contributions are being made in support of HHSF and will not misrepresent the nature or destination of funds.

I acknowledge that HHSF does not assume any liability related to my donation page. I agree to indemnify and hold harmless HHSF, its affiliates, officers, directors, employees, and representatives from all claims, liabilities, damages, expenses arising from my donation activities or any breach of these terms.

I agree that any use of HHSF’s name, logos, or branding, including in promotional or marketing materials, must receive prior written approval from HHSF. I understand that I may not alter or independently use official HHSF branding without permission. I further acknowledge that HHSF’s charitable business number may not be used without prior written approval for each instance of use.

I grant permission to HHSF to use content I submit publicly in connection with my donation page, including text, images, or videos—for recognition, promotional, or marketing purposes in any media, worldwide, in perpetuity.

I understand that HHSF will not solicit donations on my behalf, provide donors or contact lists, or incur any costs related to my donation page. I will not represent myself as an employee, agent, or official representative of HHSF.

I agree that my donation page will not be associated with any individual, organization, or activity that conflicts with HHSF’s mission, values, or priorities, or that could harm the reputation of HHSF.

I will ensure that all communications related to my donation page comply with applicable laws, including Canada’s anti-spam legislation. I will not conduct or promote any lottery, raffle, or gaming activity without prior written approval from HHSF and all required licences or regulatory approvals.

I understand that all donations must be made directly through approved HHSF platforms. I will not collect or hold donations on behalf of HHSF or establish any bank account in the name of HHSF. In the event that I receive any funds in error or outside of approved platforms, I agree to promptly remit those funds to HHSF within 30 days or as otherwise directed by HHSF. I acknowledge that only donations made through official HHSF channels are eligible for charitable tax receipts, which will be issued, where applicable, in accordance with CRA guidelines and at HHSF’s sole discretion. I agree to provide, upon request, documentation or verification of funds raised in connection with my donation activities.

I acknowledge that, unless otherwise approved in advance by HHSF, all donations will be used to support HHSF’s highest priority needs. Any request to direct funds to a specific program or purpose must be approved in writing prior to the launch of my donation page and must be clearly communicated to donors. HHSF reserves the right to reallocate funds if the original designated purpose becomes impractical or no longer feasible.

I agree to respect the confidentiality and security of any personal information I may receive through my fundraising activities. I agree that all personal information is collected on behalf of HHSF. I will only use such information for purposes directly related to administering my fundraising page in support of HHSF, will keep it secure at all times, and will not share or disclose it to any third party except as required by law or with HHSF’s consent.

I agree to immediately notify HHSF if I become aware of any issues, complaints, concerns, or suspected misuse related to my fundraising page. HHSF reserves the right, at its sole discretion, to request information related to my fundraising activities, investigate concerns, or remove or deactivate my fundraising page or withdraw permission to use its name and branding at any time. In such cases, I agree to immediately cease use of all HHSF branding and comply with any direction from HHSF regarding the disposition of funds.

I acknowledge that Hamilton Health Sciences Foundation, at its sole discretion, may remove the Giving Page from public access at any time. In such circumstances, I agree to immediately discontinue all use of HHSF trademarks and to promptly remit to HHSF, in cash, all proceeds or donations collected.

These terms and conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

These terms and conditions are in addition to any applicable HHSF.. HHSF reserves the right, at its discretion, to change, modify, add, or remove portions of these terms at any time.

These terms and conditions are binding upon me and my heirs, executors, administrators, successors, and permitted assigns.

I confirm that I am at least 18 years of age.  If I am signing on behalf of a corporation, I represent and warrant that I have the legal authority to enter into this agreement on behalf of the corporation.

By proceeding with the creation of a personal fundraising page, I acknowledge that I have read, understood and agree to these Terms and Conditions.
